Dillon Cow Horses and Reproduction Center LLC 1.
To transfer embryos from the above-named Donor Mare to the
reproductive tract of a recipient mare. The Owner/Lessee
____________________________________________ (if
Lessee please provide a copy of Lease
Agreement) agrees to the following: Owner/Lessee shall pay all
outstanding charges in full before removing the pregnant recipient and /or
Donor Mare. All charges are
payable within 10 days from billing date.
Interest of 1.5% per month will be assessed on the outstanding
balance and the laws of the State of Idaho shall apply. Owner/Lessee agrees to pay all reasonable collection and
attorney fees incurred by Dillon Cow Horses and Reproduction Center in
attempting to collect any outstanding balance. The
Owner/Lessee grants and acknowledges all lien rights afforded to Dillon
Cow Horses by the laws of the State of Idaho. Dillon Cow Horses makes the
following provisions: 1.
Donor Mare Owner/Lessee is
responsible for all Breed Registry rules and regulations. Dillon
Cow Horses assumes no responsibility in this regard. 2.
Dillon
Cow Horses reserves the right to refuse service. This includes the right, at Dillon Cow Horses’ sole
discretion, to discontinue embryo attempts or to refuse to transfer an
unsuitable embryo. 3.
Owner/Lessee must provide proof that the Donor Mare
is current on all veterinary recommended vaccinations and shots,
including, but not limited to 5-Way (Flu, Rhino, Eastern & Western
Sleeping Sickness, Tetanus Toxoid), West Nile and Strangles, prior to
being brought to Dillon Cow Horses’ Lewiston location.
All required vaccinations must have been given no more than
60 days prior to mare’s arrival at Dillon Cow Horses. 4.
Donor Mare Owner/Lessee agrees not to hold Dillon
Cow Horses liable for any disease, accident, death, etc. of Donor Mare ,
Donor Mare’s pregnant recipient and in-uteri foal.
Any insurance desired on the Donor Mare, pregnant recipient
and in-uteri foal is the sole responsibility of the Donor Mare
Owner/Lessee. Dillon Cow Horses will exercise its best judgment in
supervising all horses’ care while at Dillon Cow Horses in accordance
with standard equine management standards and practices. 5.
Donor
Mare Owner/Lessee is responsible for parentage on embryo transfer foals. Dillon
Cow Horses will exercise its Judgment in maintaining records and
identification on each Donor Mare and recipient. This contract is made in Nez Perce County State of
Idaho. Approved
